Mediation

Mediation is “a process in which the participants, with the support of the mediator, identify issues, develop options, consider alternative and make decisions about future actions and outcomes. The mediator acts as a third party to support participants to reach their own decision.”

Mediation gives you and the other party the opportunity to resolve your family law dispute in an efficient and cost effective way and avoid the need for lengthy and expensive Family Court proceedings. Even if your matter does not completely resolve on a final basis at mediation, the mediation process usually helps to narrow the issues in dispute, and places you and the other party in a frame of mind where the emphasis is on resolving the matter in a timely manner rather than lengthy litigation.

In parenting matters, it is compulsory for the parties to participate in family dispute resolution prior to commencing Family Court proceedings, unless there are grounds for an exemption from the requirement. In financial matters, it is compulsory for parties to participate in some form of family dispute resolution, which includes mediation, conciliation or arbitration.
